A class action lawsuit against Apple concerning its free 5GB iCloud storage plan has been dismissed by the United States Court of Appeals for the Ninth Circuit. The plaintiffs reportedly failed to adequately present their case.
The lawsuit alleged that Apple's offering of the free 5GB tier was deceptive, tricking users into paying for additional storage. It also included accusations of unfair business practices, breach of contract, and fraud. The core argument, as reported by Law360 via AppleInsider, was that 5GB is insufficient for users and that reducing iCloud usage is practically impossible.
However, it was revealed that two of the plaintiffs were still using the free 5GB tier, contradicting their claim that it's impossible to manage within that limit. This is not the first time the lawsuit has been dismissed; it was previously thrown out in May 2022.
The plaintiffs were given multiple opportunities to amend their case, but ultimately failed to convince the court of Apple's wrongdoing. While this lawsuit has been resolved in Apple's favor, the company is currently facing other legal challenges related to its cloud storage practices.
It's worth noting that iCloud isn't the only cloud storage option available. Alternatives like Google Drive offer a more generous 15GB of free storage and are compatible with Apple devices.
